This Auction is presented by J&L Unity Auction House and Live Auctioneers and is conducted under these Terms and Conditions as well as applicable state and local law. By participating in the auction, buyer affirmatively represents and acknowledges that he or she has read and understood the terms and conditions of sale set forth herein, and agrees to be bound by the same. Any condition statement is given as a courtesy to a client, is only an opinion and should not be treated as a statement of fact. J&L Unity Auction House shall have no responsibility for any error or omission. The absence of a condition statement does not imply that a lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. Strongly recommend buyer to examine property they are interested in before auction begins. By bidding at J&L Unity Auction House Auction, you hereby agree to be bound by the following: 1. All Sales Are Final - All lots are sold AS-IS and All sales are Final, without recourse and neither J&L Unity LLC nor its consignor(s) makes any warranties or representations, express or implied with respect to such lots. Neither J&L Unity LLC nor its consignor(s) makes any express or implied warranty or representation of any kind or nature with respect to merchantability, fitness for purpose, correctness of the catalog or other description of the physical condition, size, quality, rarity, importance, medium, material, genuineness, attribution, provenance, period, culture, source, origin, exhibitions, literature or historical significance of any lot sold. The absence of any reference to the condition of a lot does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. No statement, whether written or oral, and whether made in the catalog, or in supplements to the catalog, an advertisement, a bill of sale, a salesroom posting or announcement, the remarks of an auctioneer, or otherwise, shall be deemed to create any warranty, representation or assumption of liability. J&L Unity LLC and its consignor(s) make no warranty or representation, express or implied, that the purchaser will acquire any copyright or reproduction rights to any lot sold. J&L Unity LLC expressly reserves the right to reproduce any image of the lots sold in this catalog. 2. Refusal of Admission - J&L Unity LLC has the right, at our complete discretion, to refuse admission to the premises or participation in any auction and reject any bid. 3. Bidding at J&L Unity - The highest bidder recognized by the auctioneer will be the purchaser. The successful bidder will be personally responsible to pay the hammer price plus a Buyer's Premium of twenty five (25) percent of the gross hammer price, plus applicable sales tax and all other applicable charges. Title to the property purchased shall not pass to the purchaser until such time that all credit card transactions and payment have been received by J&L Unity payment department. 4. Removal of Purchase - All purchases, upon payment, shall be immediately removed from the premises at the purchaser's expense. J&L Unity is not responsible for any property left on the premises after seven (7) days. Packing and handling of purchased lots is at the entire risk of the purchaser. J&L Unity is not responsible for any shipping or removal of property, including work conducted by a third party representative. 5. Auctioneer's Discretion - The auctioneer has the right at his or her absolute and sole discretion to refuse any bid, to advance the bidding in such a manner as he or she may decide, to withdraw any lot, and in the case of error or dispute, and whether during or after the sale, to determine the successful bidder, to continue the bidding, to cancel the sale or to re-offer and resell the item in dispute. If any dispute arises after the sale, our sale record is conclusive. 6. Buyer Premium - In addition to the hammer price, the buyer agrees to pay J&L Unity LLC a buyer's premium and the applicable sales tax added to the final total. The buyer premium is 25% of the hammer price for floor bidders and 25% for internet bidders. Payment - The buyer must pay the entire amount due (including the hammer price, buyer's premium, all applicable taxes and other charges) no later than 11.59 p.m. on the fifth (5) business day following the sale. Payment in U.S. dollars may be made with cash. 7. Collecting Purchases - Once J&L Unity LLC. has received all funds due to us, the buyer shall collect purchased lots within seven (7) business days from the date of the sale. 8. Failure to Collect Purchases - If property is not picked up within seven (7) business days following the sale, whether or not payment has been made, J&L Unity LLC reserves the right to charge $50 per lot per day or 10% of the selling price, plus handling fee of $50. J&L Unity LLC shall have no liability for any damage to property left on its premises after seven (7) business days following the sale. J&L Unity reserves the right to re-sell any item purchased and left in our warehouse for over thirty (30) days. 9. Pre-Auction Bids - Bids which are submitted to J&L Unity LLC prior to the auction may, at the discretion of J&L Unity LLC, be executed for the convenience of the bidders. J&L Unity LLC shall not be responsible for failing to execute such bids or errors relating to the execution of such bids. Any third party representative bidding on behalf of a third party is personally responsible for any purchase made. 10. Condition Reports - J&L Unity LLC is not responsible for the correctness of any statement of any kind concerning any lot, whether written or oral, nor for any other errors or omissions in description or for any faults or defects in any lot. Neither the seller, ourselves, our officers, employees or agents, give any representation, warranty or guarantee or assume any liability of any kind in respect of any lot with regard to merchantability, fitness for a particular purpose, description, size, quality, condition, attribution, authenticity, rarity, importance, medium, provenance, exhibition history, literature or historical relevance. Except as required by local law any warranty of any kind whatsoever is excluded by this paragraph. 11. Purchased Lots - If for any reason a purchased lot cannot be delivered in the same condition as at the time of sale, or should any purchased lot be stolen, mis-delivered or lost prior to delivery, J&L Unity LLC shall not be liable for any amount since J&L Unity LLC does not offer in house shipping and delivery. 12. Legal Ramifications - The rights and obligations of the parties with respect to these Conditions of Sale, the conduct of the auction and any matters connected with any of the foregoing shall be governed and interpreted by the laws of the jurisdiction in California. If any part of these Conditions of Sale is found by any court to be invalid, illegal or unenforceable, that part shall be discounted and the rest of the conditions shall continue to be valid to the fullest extent permitted by law. 13. Discretion - Any and all of the conditions may be waived or modified in the sole discretion of J&L Unity LLC. ALL PROPERTY IS SOLD AS IS. ALL SALES ARE FINAL. WE RESERVE THE RIGHT TO CHANGE, MODIFY, AND ADD TO THESE TERMS & CONDITIONS.
